\"There's no point\"... <\/strong>And if! Because themission order <\/strong>is the contract that binds the employer to its travelling employee. It defines the framework, safety conditions and scope of responsibilities. Article l411-2 of the Social Security Code stipulates that accidents occurring outside the workplace and normal working hours are not recognised. The absence of a mission order could therefore be interpreted as negligence on the part of the employer, with serious consequences both legally and in terms of the company's reputation.<\/p>\r\n\r\n\r\n\r\n

As far as the employee is concerned, it also means that he or she will be reimbursed for travel-related expenses (fuel, train or plane tickets, hotels, meals, etc.), in accordance with the travel policy.<\/p>\r\n\r\n\r\n\r\n

\"It's only for the public sector\". <\/strong>Of course, the public sector is obliged to do this - because it involves the commitment of public funds - but the private sector is not exempt. All companies have an obligation to \"duty of care<\/strong>. Article L. 4121-1 of the French Labour Code stipulates that \".the employer must take the necessary measures to ensure the safety and protect the physical and mental health of workers<\/em>.\" This obligation applies all the more in countries exposed to health, social, meteorological, terrorist or political risks, the list of which is unfortunately growing. It's obviously much more comfortable to know exactly where your colleague is when the unexpected happens. Which is why, since COVID, employees have been required to declare their teleworking days so that, in the event of an incident or virus on site, the employer is informed of the teams' geographical location.<\/p>\r\n\r\n\r\n\r\n
